What is domestic violence?

Domestic violence is when violence occurs between people who are in a domestic relationship, meaning they are

in a close relationship sharing the same residence,
married or living as married, dating,
have a parent child relationship
are dating or in a percieved or actual intimate relationship

A victim of domestic violence could open a criminal case against the perpetrator, and /or take out a protection order.

A protection order is a court order, which prohibits the offender from continuing their abuse on the victim.

What is an Interim protection order?

An interim protection order is a temporary order granted by the court to the respondent. It is granted if the court made an assessment that the complainant’s life could be in danger.

How to apply for a protection order?

An application for a protection order can be made at a Magistrate court. An interim protection order will be issued and the victim and perpetrator will be served with a court date to appear where it will be determined if a final protection order will be issued.

Breaching a protection order?

If the perpetrator breaches a protection order he or she commits an offence, which is punishable with a fine or a period of imprisonment.
